The multi-million rand shopping complex in Mthatha in the Eastern Cape is under threat following a court battle between two companies claiming they had the rights to the development.
 
The complex, expected to cost around R90 million, is to be built at the former Independence Stadium, which was the home ground to Bush Bucks before the soccer team relocated to East London.
 
According to court papers, Tyume Properties cc was awarded the tender by the King Sabata Dalindyebo municipality.
 
The company was about to start work at the site when it learned that Lampads Investments had been given the green light to develop the complex.
 
However, in court on Tuesday, Judge Lusindiso Pakade pointed out that Tyume Properties had applied for a court order under the incorrect company name, Tyume Properties (Pty) Ltd instead of Tyume Properties CC.
 
He ruled that Tyume Properties (Pty) Ltd had no legal standing to bring the application to court.
 
Tyema official Dumisani Buwa said he would instruct his defence counsel, Advocate Lawrence Ngozi, to take the matter on appeal "as soon as possible" for a full bench hearing.
